Terms of Use — COLOSSUMYY

Welcome to COLOSSUMYY (the "Site" or the "Game"), an online social game in which players from around the world fight together against a shared virtual opponent. Your use of the Site — including registration, play and purchases — is subject to these Terms of Use and to the Privacy Policy. Registering for the Site constitutes full acceptance of these Terms. If you do not agree to these terms, please do not use the Site.
1. Who we are and how to contact us
The Site is operated by the site operator (the "Operator"). For any question, request or complaint, you may contact us by email at colossumyy@gmail.com. The Operator will make reasonable efforts to respond within a reasonable time.
Yehonatan Shalit and Yuval Benyamin — both are operators and developers of the website.
2. Minimum age — 18 and over only
Use of the Site is permitted only to individuals who are at least 18 years old. By registering, you represent and confirm that you are at least 18 years old and that you have full legal capacity to enter into this agreement under the Israeli Legal Capacity and Guardianship Law, 5722-1962. The Operator may require proof of age and may block or delete the account of any user found not to meet the age requirement, including cancellation of virtual balances, without any refund for use already made.
3. User account
- Registration requires a valid email address, a username and a password. You are responsible for keeping your login details confidential and for any activity carried out under your account.
- You may not open more than one account per person, may not transfer or sell an account, and may not use someone else's account.
- The Operator may suspend or close an account for breach of these Terms, misuse, cheating (including automation/bots), harm to other users, or any unlawful use — at its reasonable discretion.
4. Nature of the Game — a skill competition, not a lottery or gambling
COLOSSUMYY is a skill competition. The power of each attack is determined by the player's precision, timing and skill in performing the attack action (a timing meter and weak-spot targets), as well as by persistence and effort. The cash-prize winner of each battle is determined solely by the Skill Score — points earned through precisely timed and aimed actions — and the virtual-prize winners by cumulative damage; there is no element of luck, chance or randomness in determining the winners. Accordingly, the Game does not constitute a "prohibited game," "lottery" or "gambling" within the meaning of the Israeli Penal Law, 5737-1977 and the law amending the Penal Law (Prohibited Games, Lotteries and Gambling), 5724-1964 — laws that apply to games whose outcome depends on chance more than on ability.
No payment is required to participate or to win. Participation in the competition and winning prizes is open to every registered user, and it is possible to participate and win without any purchase. Purchasing virtual items does not grant a win and does not guarantee one — winning depends solely on the player's skill and effort.
The virtual items in the Game (Premium status, characters, diamonds and honor badges) are in-game benefits only, with no monetary value, and are not convertible to money or transferable. In addition, and for clarity, the player who finishes with the highest Skill Score in each battle may receive a cash prize of US $5, subject to the conditions set out in Section 7. The Skill Score is earned exclusively through precision actions (perfectly timed hits and weak-spot hits) whose earning opportunities occur at an identical rate for every player — purchasing Premium, characters or any other paid item grants no advantage whatsoever toward the cash prize.
5. Virtual currency ("diamonds") and virtual items
- "Diamonds," characters, Premium status, cosmetic name colours, Rift Shards and any other in-game item (the "Virtual Items") are a limited, personal and non-transferable license to use within the Game only — and are not property, currency, a financial asset or a cash equivalent.
- Earning diamonds through play: diamonds are credited automatically at a rate of 1 diamond per 10 points of damage dealt (computed from cumulative damage so no remainder is lost). Individual hits do not pay diamonds directly. Additional in-game diamond sources (participation rewards, placement prizes, wheels, Raider Road, Rift Events, referrals) are described in Sections 7–7C. The Operator may adjust these rates prospectively for game balance.
- The Virtual Items have no monetary value outside the Game. They cannot be converted into real money, cannot be sold or transferred, and cannot be inherited or pledged.
- For reasons of game balance, integrity or security, the Operator may change from time to time the prices of items, their attributes (including damage values), their availability, or the game rules — provided that a payment lawfully made will not be retroactively revoked.
- Time-based champions (v4.0): champions are accessed by purchasing champion time with diamonds (2 hours / 24 hours / 7 days, at the prices shown in the store). Buying more time adds to any remaining time. Champion time persists across boss battles (champions no longer reset when a boss dies); when the time expires, the champion locks again and the player returns to the free "Novice Squire" (free forever). Each champion has a fixed damage value and a disclosed in-game ability; abilities and purchasable damage boosts affect DAMAGE only and never grant Skill Score, so they have no effect on the cash prize. Champion time, boosts and abilities are validated server-side and are Virtual Items under this Section.
- Other diamond purchasables: the store also sells, for diamonds: timed damage Boosts, Wheel Tickets (Common/Rare/Epic only — Legendary is never sold), Diamond Contracts (24-hour skill challenges with fixed disclosed rewards), spins of the Diamond Rift Wheel (odds disclosed in the wheel), and cosmetics (name colours, hit effects). Lifetime diamond-spend milestones grant one-time ticket rewards. All are Virtual Items; none grant Skill Score or affect the cash prize.
- Upon closure of an account by the user or due to a breach of these Terms, any Virtual Items remaining in the account will expire without compensation.
6. Purchases, payments and cancellation policy
- Purchases on the Site (Premium status — 30 days, or the 5-day starter offer — diamond packs, and Wheel Packs — bundles of Wheel Tickets and diamonds) are processed through the payment provider PayPal. The Operator does not store your payment details. All purchased items are Virtual Items under Section 5 with no monetary value. A first-purchase bonus (extra diamonds on diamond packs, one Common ticket and a 24-hour name colour) is granted once per account on the first completed payment.
- Premium — duration and renewal: "Premium" status is a time-limited benefit that lasts 30 days from the moment it is credited. It is a one-time charge with no automatic renewal and no recurring billing whatsoever; when the 30 days end, Premium simply lapses, and you may choose to purchase it again to continue. Premium awarded to top players as a battle prize is likewise limited to 30 days. Any "lifetime" Premium granted to an account before July 6, 2026 remains honored for that account and is unaffected by this change.
- Prices are shown in US dollars and include tax where applicable. The Operator may update prices from time to time; an update will not apply to a purchase already completed.
- Immediate delivery: The purchased benefits (diamonds / Premium) are credited to your account immediately and automatically upon payment confirmation. By making the purchase you consent to immediate delivery.
- Cancellation policy: Under Section 14C of the Israeli Consumer Protection Law, 5741-1981, the right of cancellation in a distance-selling transaction does not apply to "information" and digital content that has been supplied. Therefore, once the digital benefit has been credited to your account, the transaction cannot be canceled and no refund will be given, except where there was a material defect in delivery. If you were charged and did not receive the benefit — contact us and we will fix it or refund you.
- An unlawful attempt to reverse a charge (chargeback) for a benefit that was fully delivered may result in suspension of the account.
7. Competition prizes and the cash prize
- Seasons and the community-scaled boss: each "boss battle" is a season. Every player who joins a season and performs at least one attack becomes a participant, and each participant increases that boss's health by a fixed amount (currently +10 HP per participant) — so a boss with more participants has more health and takes longer to defeat. This scaling affects every player equally and does not depend on any purchase. When the boss is defeated the season ends, the cash prize is awarded, and all season progress (Skill Scores, damage rankings and the boss's accumulated health) resets for the next season. The Operator may change the per-participant amount from time to time; a change applies only to seasons that begin after it is published.
- At the end of each "boss battle," prizes are awarded on two separate tracks. Each top-3 place is a bundle of virtual items (and, for Skill #1 only, the cash prize). (a) the Skill track — earned only through precisely timed hits and weak-spot hits, at an equal opportunity rate for all players: 1st: a cash prize of US $5 + a Rare Wheel Ticket + 12 hours of Premium + 1,000 virtual diamonds; 2nd: a Common Wheel Ticket + 6 hours of Premium + 400 virtual diamonds; 3rd: 3 hours of Premium + 250 virtual diamonds. (b) the Damage track (virtual prizes only) — 1st: a Rare Wheel Ticket + 6 hours of Premium + 1,000 virtual diamonds; 2nd: 3 hours of Premium + 500 virtual diamonds; 3rd: 1 hour of Premium + 250 virtual diamonds. The Premium time here is granted in hours/days and extends any existing Premium; it is not the 30-day paid Premium. In addition, players earn small diamond participation rewards during a fight (for hit streaks and reaching cumulative-damage milestones), and every participant in the kill receives a virtual reward chest (diamonds) when the boss falls. Premium members receive 50% more virtual diamonds from the placement prizes on both tracks (based on their Premium status at the moment the boss dies); this is a virtual-diamond (in-game) benefit only and does not affect the cash prize. Wheel Tickets awarded as prizes are never Legendary — see Section 7A.
- The cash prize ($5): is a recognition of a skill achievement (the highest Skill Score achieved through precision, timing and reaction) and is not a win in a lottery or gambling. Paid items give no advantage toward it. The prize is paid manually by the Operator to the skill winner, using a payment method the winner provides (e.g. PayPal).
- Conditions for receiving the cash prize: (a) the winner must be 18 or older; (b) the Operator may require identity and age verification before payment; (c) the winner is solely responsible for any tax or reporting obligation applicable to them in respect of the prize; (d) the winner must contact the Operator at the email address in Section 1 within 30 days of winning and provide payment details — otherwise the right to the cash prize will expire; (e) the prize is personal and non-transferable.
- The Operator may disqualify results and revoke prizes (including the cash prize) obtained through cheating, exploiting a bug, automation/bots, multiple accounts, misuse or breach of these Terms.
- The amount of the cash prize, the composition of the prizes and their conditions may change from time to time; a change will apply only to battles that begin after it is published. The Operator may, at its discretion, limit, suspend or discontinue the cash prize at any time and for any reason.
7A. Reward Wheels, Wheel Tickets and the Raider Road
- The Game offers reward wheels: (a) a Free Wheel available to every player once every 72 hours; (b) the Royal Wheel (formerly named the "Premium Wheel") available to Premium members once every 24 hours as a benefit of their existing Premium status; and (c) ticket wheels — Common, Rare, Epic and Legendary — each spun by redeeming one matching Wheel Ticket. A wheel spin is never charged per-spin: the Free Wheel is free to all, and the Royal Wheel is included in Premium at no per-spin cost.
- Wheel Tickets are obtained in two ways: (1) earned in-game — from Raider Road milestones (below), from finishing top-3 of a boss battle, from a 50-hit attack streak, and from Rift Events (Section 7C — event levels, event leaderboard placements and Rift Shard redemption); and (2) purchased as part of a "Wheel Pack" — an optional real-money bundle that grants a fixed number of Wheel Tickets plus diamonds (current packs: Starter — 700 diamonds + 3 Common tickets; Rare — 1,200 diamonds + 2 Rare tickets; Epic — 5,500 diamonds + 2 Epic + 3 Rare + 4 Common tickets; exact contents are shown at the point of sale). Legendary Wheel Tickets are NEVER sold and are never a regular top-3 prize — they are obtained only from high Raider Road milestones, from redeeming 8 Rift Shards, and from special events. The Legendary Wheel is displayed to all players, but can be spun only with a Legendary Ticket. Ticket quantities and every grant are stored and validated server-side. Buying a Wheel Pack grants tickets and diamonds only; it does not grant any wheel outcome in advance and has no effect on the cash prize, which stays skill-decided.
- The Raider Road is a lifetime progression ladder tied to your Account Level (1–1000), which increases with lifetime damage dealt and never resets or decreases. Reaching a milestone level lets you claim its reward once (virtual diamonds, Wheel Tickets, Premium time and/or a temporary name colour). Milestone rewards are Virtual Items under Section 5.
- A wheel spin awards only one of the following, chosen at random server-side: virtual diamonds, a temporary cosmetic name colour, or additional Premium time. A wheel never awards the cash prize, real money, or Skill Score, and therefore has no effect on the cash prize, which continues to be decided solely by skill. This is also displayed under every wheel.
- The probability (odds) of each possible reward is disclosed in the wheel interface before you spin. All rewards are Virtual Items within the meaning of Section 5 — they have no monetary value, are non-transferable and non-refundable.
- The name colour reward is purely cosmetic: it lets you display your player name in a chosen colour for a limited time. It confers no gameplay or prize advantage.
- The Operator may change, add, remove or discontinue the wheels, the tickets, the Raider Road, their rewards, odds, milestones and availability at any time; a change applies from the time it is published.
7B. Lifetime-skill special events
- Lifetime Skill is a cumulative, never-resetting counter of skill points earned through play. It is a prestige statistic; the Lifetime Damage board is likewise prestige-only and never awards cash.
- 500,000 Lifetime Skill reward: the first 100 players to reach 500,000 Lifetime Skill each receive, once per player, 10 Legendary Wheel Tickets. Claims are recorded server-side; once 100 players have received it the reward is closed.
- $100 Lifetime Skill Event (LIMITED TIME — ends September 8, 2026): a one-time cash prize of US $100 to the first verified player to reach 1,000,000 Lifetime Skill before the end date. Crossings after September 8, 2026 do not qualify. There is exactly one winner, and one prize per real person. Reaching the threshold does not automatically win: the crossing is recorded and then subject to manual anti-cheat review and the Operator's approval before any payout. Play found to involve cheating, automation, multiple accounts or exploitation of bugs is disqualified. The conditions of Section 7 (age, verification, tax, 30-day contact window, non-transferability) apply. The Operator may modify or cancel this event prospectively at any time before a verified winner is confirmed.
7C. Rift Events
- Rift Events are timed worldwide in-game events, currently held twice a week (Tuesday and Thursday at 20:00 UTC, for one hour). During an event, players earn Rift Points exclusively through timed play: well-timed hits, gold-pixel hits, weak-spot hits and hit streaks; a mistimed (red) hit subtracts points. Premium status, diamonds, champions, damage output and any purchased item grant no Rift Points whatsoever — the event is a pure skill activity with equal earning opportunity for every player.
- Rift Points reset after every event. A separate cumulative "Lifetime Rift Points" counter is a prestige statistic only. During an event, reaching point thresholds ("event levels") automatically grants fixed rewards (virtual diamonds, Wheel Tickets, and — at level 6 — one Rift Shard), each claimable once per event. At the end of each event, the event leaderboard grants virtual prizes to the top finishers (tickets, diamonds, and one Rift Shard for 1st place). Random short "event effects" (bonus-point windows) may occur during an event at the same moment for all players.
- Rift Shards are a rare Virtual Item obtained only from the level-6 event milestone and the 1st-place finish. They can be redeemed in-game: 4 Shards for one Epic Wheel Ticket, 8 Shards for one Legendary Wheel Ticket. Shards are never sold.
- Rift Events award no cash prizes and have no effect on the cash Skill Prize (Section 7), which continues to be decided solely by the normal Skill Score. All Rift Event rewards are Virtual Items under Section 5. The Operator may change the event schedule, points, effects, levels, rewards and availability prospectively at any time.
8. Code of conduct (chat and community)
It is strictly prohibited to publish or send on the Site (including in chat, usernames and group names): offensive, threatening, racist or sexual content, defamation, harassment, other people's personal details, spam, malicious links, content that infringes copyright, or any unlawful content. The Operator may (but is not obligated to) monitor, remove content and suspend violators. Messages sent may be retained for operational, security and complaint-handling purposes. The global chat clears itself automatically every 100 messages; do not rely on chat as storage for any content. Full responsibility for content a user publishes rests solely with that user.
9. Intellectual property
All rights in the Site and the Game — including the code, design, the COLOSSUMYY name, graphics, characters and text — belong to the Operator or its licensors. You are granted a personal, limited, non-commercial right to use the Game. You may not copy, reproduce, reverse-engineer, distribute or make any commercial use of any part of the Site without prior written permission.
10. Availability, changes and discontinuation of service
The Site is provided "AS IS" and without any commitment to continuous availability. There may be faults, maintenance outages, data loss or changes to the Game. The Operator may modify, suspend or discontinue the service, in whole or in part, at any time. Should a complete shutdown of the Game be decided, reasonable advance notice will be published on the Site.
11. Limitation of liability
Subject to any law that cannot be contracted out of: the Operator shall not be liable for any indirect, consequential or special damage, or for loss of profits, data or goodwill, arising from the use of the Site or the inability to use it. The Operator's total liability under any cause of action shall not exceed the amount actually paid by the user to the Operator in the 12 months preceding the event. Nothing herein derogates from rights that cannot be contracted out of under the Consumer Protection Law or any other law.
12. Indemnification
You undertake to indemnify the Operator for any damage, expense or third-party claim arising from your breach of these Terms or from unlawful use of the Site by you.
13. Privacy
The collection and use of information are governed by the Privacy Policy, which forms an integral part of these Terms, in accordance with the Israeli Protection of Privacy Law, 5741-1981 (as amended, including Amendment 13).
Game updates (opt-in): if you tick "I agree to receive game updates and announcements" in your profile, the Operator may send you game-update messages by email and in-game notices. You can withdraw consent at any time by unticking the box. Reports submitted through the "Report a Problem / Suggestion" tool (including the email and message you provide) are stored and forwarded to the Operator for handling.
14. Changes to the Terms
The Operator may update these Terms from time to time. An updated version will be published on this page with an update date, and for a material change a notice will be shown on the Site. Continued use after the update constitutes acceptance of the updated version.
15. Governing law and jurisdiction
These Terms and the use of the Site are governed solely by the laws of the State of Israel. Exclusive jurisdiction over any dispute is granted to the competent courts of the Tel Aviv-Yafo district.
